Following implementation, the client reported increased staff confidence in internal reporting mechanisms and praised the professionalism and speed of our response.

Key Legislative Changes You Need to Know in 2024–2025

As regulatory expectations increase, organisations that don’t have robust whistleblower protections in place face heightened risks. Here’s what’s changing:

📌 Corporations Act 2001 (Cth)

Whistleblower protection reforms commenced 1 July 2019, strengthening rights for disclosers and increasing civil and criminal penalties for retaliation or mishandling reports.

📌 Respect@Work – Sex Discrimination Act 1984 (Cth)

From 13 December 2022, employers have a positive duty to prevent sexual harassment, sex-based discrimination, and victimisation in the workplace.

📌 Fair Work Act 2009 (Cth)

Amendments introduced under the Secure Jobs, Better Pay Act (in effect from 6 March 2023) extend protections to employees reporting misconduct.

📌 Aged Care Act 2024 (Cth)

Coming into effect 1 July 2025, this new legislation imposes significant new responsibilities on aged care providers:

- Sections 547 to 554 & 550-1: Expanded duties and penalties for non-compliance

- Draft Rules including Section 165: New requirements for complaints management and whistleblower procedures
